Issue L

“How to revise Section 7.12 of the covenants to acknowledge practical limitations regarding the management of noxious weeds on Subdivision lots.” [Problem Statement #8 in the survey]

The current covenants, as well as county law, require property owners to control and eradicate noxious weeds (not just treat them). By 23 to 15 the membership surveys favored doing something different.  (Pro-change members score= 1.53). But few comments made suggestions, except to note the lack of enforcement authority for the HOA. 

This proposal would reconfirm that weed control is the responsibility of every land owner, and amend the Covenants to state that primary enforcement of weed control is the responsibility of Teton County. The proposed language is in the Draft Covenant Proposals, Article VII at section 7.12 (on the Saddlehorn Blog).

  1. What’s the process, then, if an absentee owner’s lot is covered in thistles? Would fines apply, if they don’t respond to a request for weed control?

  2. Seems reasonable but enforcement unlikely. Prior to purchasing the lot next to us it was full of thistle and didn’t seem the land owner ever took any interest in addressing. Not sure how this would change any behavior as stated.
