How to assess the consensus will of the HOA regarding short- and long-term rentals in the subdivision and enforce that consensus.” [Problem Statement #13 in the survey]

 The current covenants prohibit any commercial use of lots. Sec7.1 states: “No residence shall be used for any purpose other than single-family residential purposes”, and it also states, “This does not prohibit the rental of property by its owner for residential purposes, on either a short- or long-term basis.” The expanding use of subdivision lots for VRBO and Airbnb purposes crowds the line between single-family residence and commercial use.  By 19 to 19 membership surveys were pretty evenly divided on addressing this issue.  (Pro-change members score= 1.0)

In part due to the split in membership opinion, the Board concluded that no action should be taken on this subject at this time. In addition, there are legal questions about what rentals the current covenants do, or do not allow. Therefore, these issues deserve more study in the future by the HOA.

  1. We do not support the commercialization of our subdivision by allowing landowners to build structures solely for the purpose of short-term rental income.

  2. Homes built primarily for short-term rental income are of no benefit to the neighborhood. We get none of the plusses of having neighbors around, yet have to deal with negative impacts of rentals like excess trash, lights on all night, off-roading, etc.

  3. With the lack of long term rentals available in Teton Valley I support the use of a residence for that purpose. Long term renters are usually an asset to our community. However, I am against short term rentals.

  4. Regardless of opinions on rentals the Idaho Legislature has passed laws prohibiting cities or counties from restricting short or long term rentals. In addition in 2016 they passed a bill stating that no HOA can change rules that will limit the ability to allow homeowners to rent their property.
